TERMS AND CONDITIONS OF SALE

ARTICLE 1 - Scope of Application

These General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to all sales concluded by Birdcage Hats ("the Seller") with consumers and non-professional buyers ("the Customer") through the website www.birdcagehats.com ("the Website").

The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the Website. The Customer is responsible for reviewing them before placing an order.

Placing an order for a Product implies the Customer’s full acceptance of these GTCS.

These GTCS prevail over any other version or conflicting document and may be modified at any time. The applicable version is the one in force at the time of order placement.

The Customer acknowledges having read these GTCS and accepted them before finalizing their purchase.

ARTICLE 2 - Orders

Orders are placed directly on the www.birdcagehats.com website.

To place an order, the Customer must:

  1. Select the desired Product(s) and add them to the cart.
  2. Provide necessary personal information (name, address, email, phone number).
  3. Choose a payment method and complete the transaction.
  4. Receive an order confirmation email from the Seller.

Orders are considered final only after full payment has been received.

The Seller reserves the right to:

  • Refuse an order in case of abnormal requests, suspected fraud, or payment issues.
  • Cancel an order if the Product is unavailable (with a full refund to the Customer).

 

The Seller cannot be held liable for input errors made by the Customer when entering order details.

ARTICLE 3 - Prices

Prices for Products are displayed in euros (€), including all taxes (VAT included), but excluding shipping costs.

The applicable price is the one displayed at the time of order placement.

The Seller reserves the right to modify prices at any time. However, no price changes will apply to orders already confirmed.

Shipping costs are calculated separately and communicated to the Customer before order confirmation.

In case of an error in the displayed price (significantly incorrect due to a technical issue), the Seller reserves the right to 

cancel the order and issue a full refund.

ARTICLE 4 - Payment Terms

Payment for orders must be made in full at the time of purchase using one of the following methods:

  • Credit/debit card (Visa, Mastercard, etc.)
  • PayPal
  • Other secure payment methods available on the Website

Transactions are processed securely through an encrypted system to protect the Customer's banking details.

If payment is refused or incomplete, the order will not be processed.

The Seller does not store Customer payment details.

ARTICLE 5 - Delivery

Products are delivered to the address provided by the Customer during the order process.

Delivery Times

Estimated delivery times are indicated at the time of order confirmation. The Seller makes every effort to respect these times, but delays may occur due to external factors (e.g., postal disruptions, customs delays).

Shipping Costs

Shipping costs depend on the delivery method selected and the destination. They are clearly stated before order confirmation.

Delivery Issues

If the Customer notices any damage or missing items upon delivery, they must:

  1. Notify the carrier immediately and make a note on the delivery receipt.
  2. Contact the Seller within 48 hours at info@birdcagehats.com with photos and details.

If the package is lost during shipping, the Seller will conduct an investigation and offer a replacement or refund.

The Seller is not responsible for delivery delays caused by incorrect Customer information or force majeure events.

ARTICLE 6 - Transfer of Ownership and Risks

The transfer of ownership occurs only after full payment of the order by the Customer.

However, the transfer of risks (loss or damage to the Product) occurs upon delivery to the Customer.

If the Customer chooses a third-party carrier (not offered by the Seller), the risk transfer occurs when the package is handed over to that carrier.

ARTICLE 7 - Right of Withdrawal

In accordance with current legal provisions, the Customer has a period of 14 days from receipt of the Product to exercise the right of withdrawal without having to provide a reason or pay penalties, except for return shipping costs, which are the responsibility of the Customer.

The right of withdrawal can be exercised before the deadline by sending a clear and unequivocal statement via:

  • Online withdrawal form, available on the website www.birdcagehats.com

Products must be returned within 14 days of sending the withdrawal notice, in their original condition, complete with packaging and accessories, so that they can be resold.

Return shipping costs are borne by the Customer.

The refund will be issued within 14 days of receiving the returned Products, using the same payment method chosen by the Customer at the time of purchase.

The Seller may delay the refund until the Products have been received or proof of their shipment has been provided, whichever comes first.

Exceptions to the right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply in the following cases:

  • Customized or personalized products made at the Customer's request.
  • Sealed products that, once opened after delivery, cannot be returned for hygiene or health protection reasons.

ARTICLE 8 - Seller’s Liability - Warranties

Products sold on the www.birdcagehats.com website comply with current French regulations and automatically benefit from the following legal warranties:

Legal warranty of conformity

(Articles L217-4 and following of the French Consumer Code)

The Seller is responsible for ensuring that the Product conforms to the contract.
The Customer may request a free repair or replacement of the Product if it presents a conformity defect within 2 years of delivery.

If repair or replacement is impossible, the Customer may request a refund.

Legal warranty against hidden defects

(Articles 1641 and following of the French Civil Code)

If the Product has a hidden defect that renders it unusable or significantly impairs its use, the Customer may request cancellation of the sale or a price reduction.

To invoke one of these warranties, the Customer must contact the Seller by email or postal mail using the contact details provided in Article 1.

ARTICLE 9 - Protection of Personal Data

In accordance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679), the Seller collects only the strictly necessary data for order processing and customer service.

The personal data collected includes:

  • Full name
  • Shipping and billing address
  • Email address
  • Phone number
  • Payment details (securely processed by payment service providers)

This data is retained for the time necessary to process orders and in compliance with legal and tax obligations.

The Customer has the right to:

  • Access, rectify, or delete their personal data.
  • Object to data processing or request its restriction.
  • Request data portability.

The Seller guarantees that personal data will not be shared with third parties without the Customer’s consent.

ARTICLE 10 - Intellectual Property

All elements of the www.birdcagehats.com website, including texts, images, designs, logos, and graphics, are protected by intellectual property rights and remain the exclusive property of the Seller.

Any reproduction, modification, or unauthorized use is strictly prohibited and constitutes a violation of copyright laws.

ARTICLE 11 - Force Majeure

The Seller shall not be held liable for the non-performance of an order in cases of force majeure, including but not limited to:

  • Natural disasters (floods, earthquakes, fires)
  • Wars, terrorist acts
  • Strikes, roadblocks, or transport disruptions
  • Failures in computer or telecommunications systems beyond the Seller’s control

If the force majeure event persists for more than 30 days, either party may cancel the order without penalties.

ARTICLE 12 - Applicable Law - Disputes

These General Terms and Conditions of Sale and related transactions are governed by French law.

In case of a dispute, the Customer is encouraged to contact customer service at info@birdcagehats.com to seek an amicable resolution.

If no solution is found, the Customer may:

  • Contact a consumer mediator free of charge, as per the French Consumer Code.
  • Initiate legal proceedings before the competent French courts.
